Annual Auction

Thank you for participating in this year’s events: the Fundraising Gala & Live Auction, and the Annual Auction. Both of these events raise money for the Koi Pond Fund and every dollar raised goes directly to improving and enriching our student’s education. As a reminder, only donations made through the Fund-A-Need appeal count toward a family’s annual campaign donation total and are 100% tax deductible.

Restriction/Item Value: All items are sold “AS IS” and are not warranted or guaranteed by Design Tech High School. While Design Tech High School has attempted to describe the auctioned items accurately, Design Tech High School neither warrants nor represents and in no case shall be responsible for the accuracy of any description, genuineness, authorship, or condition of any auctioned item. No statement made by Design Tech High School or anyone representing Design Tech High School shall be deemed to be a warranty, representation, or the assumption of liability with respect to any auctioned item. With respect to all auction items, Design Tech High School expressly disclaims a warranty of merchantability and warranty for fitness for a particular use or any other warranty expressed or implied that may arise by operation of law.

Any dispute or claim arising from the auctioned item must be resolved with the donor of the item or service. Design Tech High School recommends that you do your own research on value, use, restrictions, risks, dangers, etc., to avoid issues or disappointment.

Each bidder assumes all risks and hazards related to the auction and any items obtained at the auction. To the fullest extent permitted by law, each bidder shall indemnify, defend and hold harmless Design Tech High School, its officers, directors, employees, volunteers, agents, and representatives (“DTHS Parties”) from and against any and all claims, demands, actions, causes of action, suits, losses, liability, expenses, penalties, obligations, errors, omissions and costs, including but not limited to attorney’s fees and expert witness fees, whether or not suit is actually filed, and/or any judgment rendered against Design Tech High School and/or DTHS Parties, arising out of, or in connection with, the auction or auctioned items.

The amount of the auction price in excess of the item’s fair market value may qualify as a charitable deduction. Any auction item values that have been provided are estimates of fair market value. Items have not been appraised. Consult your tax advisor to determine if a deduction is available.

All physical auction items must be picked up at Design Tech High School (275 Oracle Parkway Redwood City, CA). Winning bidders will be notified by email of the pickup date/time.

All auction purchases are final and are not refundable or exchangeable. An item’s safety and security are the winning bidder’s responsibility after the item is claimed by the winning bidder.
